A federal judge set a date to hear whether the legal battle over Tom Benson’s estate will remain in federal court or will be moved back to a county probate court in San Antonio, according to a report by the Times-Picayune on April 14.
U.S. District Judge David Ezra will hear arguments on May 21 on whether or not the dispute over Tom Benson’s family assets should stay in federal court. The lawyers of the Pelicans and Saints owner previously filed a motion to move the case to federal court. As a response, Tom Benson’s daughter Renee requested to bring the battle back to a Bexar County probate judge.
Tom and Renee are at war with each other in a legal dispute over the family trust. Last January, Tom Benson said he wanted his two teams to be inherited by his wife of 10 years, Gayle Benson, and not by his daughter and her two kids as previously planned. His daughter then filed lawsuits that claim her father is incompetent and can no longer manage the family trust.
