Additionally, in an effort to keep our readers informed about what is happening in the world of probate and general litigation, we’ll be discussing two topics in depth: (1) The procedure established by Berroteran v. Superior Court for determining when former deposition testimony can be admitted to trial; and (2) when, according to Balisteri v. Baliesteri, must a trust’s instructions be followed in order to modify the document.

Berroteran v. Superior Court Clarifies Standards for California’s Former Testimony Hearsay Exception

 

What does California Evidence Code section 1291 say about admission of former deposition testimony at trial? How is a deposition different from trial testimony? The Berroteran v. Superior Court decision sets up the procedure for trial courts to determine whether California’s former testimony hearsay exception has been met.

 

 

Amending Trust Requires Specified Trust Modification Method to Be Followed

 

In the recent appellate case, Balisteri v. Balisteri, the Court of Appeal held that when a trust modification method is specified in the trust instrument as a method of amendment, that method must be followed exactly for the amendment to be effective. Summer Events at Keystone

This summer has been a blast here at Keystone! We celebrated our annual Summer Party at the Viceroy where employees and guests enjoyed dinner and drinks. In August, our night out at the Dodgers game was a “hit” with the Dodgers blowing out the Marlins.
