SPECIAL RULE OF APPOINTMENT WHEN A WILL DOESN'T NAME AN EXECUTOR

The Probate Code provides a unique rule for the order of appointment of a decedent’s personal representative in instances where the decedent dies leaving a will, but when the decedent’s will either names no executor or the named executor is unable or unwilling to act.

NEW LAW ALLOWS ESTABLISHMENT OF OWN SPECIAL NEEDS TRUST

New federal legislation now allows a mentally competent but physically disabled individual to establish his/her own Special Needs Trust, without the previously-required involvement of family members or the courts.
