Keystone is excited to publish the Winter 2019 edition of its quarterly newsletter! Keystone has included in this edition a recap of its most noteworthy 2018 successes, as well as an in-depth analysis on two recent cases which interpret commonly-used provisions of the Probate Code: one which discusses the “specificity” requirement for a valid power of appointment under Probate Code section 632; and another which considers the reach of the attorney fee shifting provision of Probate Code section 17211. POWELL V. TAGAMI: AN EXPANSIVE INTERPRETATION OF PROBATE CODE SECTION 17211 |
|
Keystone analyzes a case that applies the fee shifting provision of Probate Code section 17211, this time against a beneficiary who brings bad faith objections to the trustee’s account. Here, the court not only charged the beneficiary for the trustee’s trust counsel’s fees, but also for the fees of the trustee’s personal counsel, who was separately retained to respond to charges of wrongful conduct against the trustee. |
