In claims for breach of fiduciary duty under the Family Code by the surviving spouse of a decedent, the court recently declined to apply the one-year statute of limitations of Code of Civil Procedure sections 366.2 and 366.3, and instead held that the only limit to when such an action may be brought is the equitable doctrine of latches.
